Israeli employment law is not only about knowing your rights – it is about knowing when and how to act

In an employment dispute, the steps taken before a lawsuit may be just as important as the arguments ultimately made in court.

Adv. Yuval Rabello graduated with honors from the Faculty of Law at the Hebrew University of Jerusalem and holds an MBA. His professional background includes public-sector legal experience, including employment-law matters, commercial legal work at a leading Israeli law firm, and civil and commercial litigation.

This combination allows an employment dispute to be examined not only from the perspective of the legal rule, but also from the perspective of evidence, leverage, commercial interests and the most effective route toward resolution.

Depending on the circumstances, that may mean preparing for a pre-termination hearing, sending a formal legal letter, negotiating an improved exit package, pursuing unpaid compensation, or filing proceedings before an Israeli Labor Court.

✓
Litigation-Oriented Analysis Evidence and legal arguments are assessed with a view toward what may happen if the dispute reaches court.
✓

✓
Negotiation Before Litigation Where appropriate, we seek to build sufficient legal leverage to resolve a dispute without full litigation.

EMPLOYMENT LAW IN ISRAEL

Working in Israel but unfamiliar with Israeli employment law?

Employment practices that may be familiar in the United States, the United Kingdom or elsewhere do not necessarily reflect the legal requirements that apply in Israel.

Israeli employment law contains mandatory employee protections that may apply regardless of the wording of an employment contract. At the same time, employment disputes frequently turn on the specific agreement, compensation structure, workplace communications and the circumstances surrounding termination.

This can be especially relevant to executives, foreign employees, employees of multinational companies, Israeli employees reporting to managers abroad, and companies employing personnel in Israel.

Before taking an irreversible step

Consider obtaining legal advice if:

  • You have received a notice inviting you to a termination hearing.
  • Your employer has proposed a separation or exit package.
  • You are considering resigning because your working conditions changed.
  • Your commission, bonus or other compensation has not been paid.
  • Your employer has changed your role, salary or responsibilities.
  • You believe the decision to terminate you has already been made.
  • You have been asked to sign a waiver or release of claims.
  • You employ personnel in Israel and are considering termination.

HOW WE APPROACH A CASE

Four steps to assessing an employment dispute

Before deciding whether to negotiate, send a legal letter or file a claim, the factual and financial picture needs to be understood.

1

Understand the Facts

When employment began, what the agreed terms were, what happened and what has changed.

2

Review the Documents

Employment agreements, payslips, commission plans, correspondence, hearing notices and termination documents.

3

Calculate the Exposure

Salary, severance, pension contributions, commissions, notice pay and other potential claims.

4

Choose a Strategy

Advice, a hearing response, legal correspondence, negotiation or Labor Court proceedings.

LEGAL FEES

How much does an employment lawyer in Israel cost?

The cost depends on the type and scope of legal work. A focused consultation is different from negotiations or full representation before the Labor Court.

Before legal work begins, it is important to determine what is actually required: assessment of rights, preparation for a hearing, drafting a formal letter, negotiation over an exit package, review of an agreement or litigation.

Legal Consultation Review of the circumstances, documents, risks and available options.
Hearing Preparation Review of the employer's allegations and preparation of a structured response.
Legal Letter Demand letter, warning letter or formal response to an employee or employer.
Negotiation Negotiating compensation, separation terms or resolution of a dispute.
Agreement Review Employment agreement, separation agreement, release or settlement documentation.
Labor Court Proceedings Claims, pleadings, hearings, evidence and settlement negotiations.
There is no single fee structure appropriate for every Israeli employment-law matter. Once the circumstances and required scope of work are understood, the appropriate structure can be discussed in advance.
ISRAELI EMPLOYMENT LAW GUIDE

What does an employment lawyer in Israel do?

An employment lawyer in Israel advises employees and employers regarding the legal relationship between them, from the beginning of employment through compensation, working conditions and ultimately resignation or termination.

Employment-law representation is not limited to filing lawsuits. In many matters, the most important legal work takes place before proceedings begin: reviewing documents, evaluating legal leverage, preparing for a hearing, drafting correspondence, calculating potential claims and conducting negotiations.

For English-speaking clients, there is an additional practical consideration: understanding how Israeli employment-law terminology and procedures differ from those used in other jurisdictions. A concept that sounds familiar in English may operate differently under Israeli law.

Employee rights in Israel – what should be reviewed?

An assessment of employee rights generally begins with the full employment relationship rather than with one isolated incident. Relevant issues can include the period of employment, contractual salary, payslips, pension contributions, vacation, variable compensation and the circumstances surrounding termination.

Salary & Payslips Whether the compensation actually paid reflects the contractual terms and applicable requirements.
Pension & Severance Contributions, severance arrangements and possible deficiencies at termination.
Vacation & Other Rights Accrued rights and payments associated with the employment relationship.
Commissions & Bonuses Whether variable compensation was calculated and paid according to the applicable plan.
Termination Procedure The hearing process, notice and the circumstances in which the decision was made.
Protected Circumstances Whether additional statutory protections may apply to the particular employee.

The pre-termination hearing in Israel

One feature of Israeli employment law that can surprise employees from abroad is the importance of the pre-termination hearing process, commonly referred to in Hebrew as a shimua.

The purpose of the hearing is to give the employee a meaningful opportunity to present his or her position before the employer reaches a final decision. This means that waiting until after termination may sometimes waste an important opportunity.

Before a hearing, it may be necessary to assess the reasons provided by the employer, the documents on which it relies, the amount of preparation time provided and whether the circumstances suggest that the outcome has already been decided.

Termination of employment in Israel

Termination disputes may involve much more than the simple question of whether an employer is permitted to end an employment relationship.

Relevant issues can include the procedure followed before termination, notice pay, severance arrangements, outstanding salary or benefits, commissions, discrimination allegations and the employer's reasons for making the decision.

For executives and highly compensated employees, the commercial significance of the dispute can be considerable. A careful review may therefore involve not only statutory rights but also bonuses, equity arrangements, commissions, contractual benefits and the proposed separation package.

Sales commissions after termination

Commission disputes are particularly common where a salesperson, account executive or senior employee worked on transactions that closed, were invoiced or became payable close to the termination date.

There is no useful answer based solely on the statement that the employee "left before the deal closed." The employment agreement, commission plan, wording of the entitlement conditions, course of dealing between the parties and factual development of the transaction may all matter.

For a more detailed discussion, see our guide to sales commissions after termination in Israel .

Resignation following a material change in working conditions

Employees sometimes assume that if an employer materially changes their salary, role, working hours or other conditions, they should simply resign and pursue their rights later.

That can be a mistake. Depending on the circumstances, the steps taken before resignation may have significant legal consequences. It may be necessary to identify the alleged breach, notify the employer and consider whether the employer should first be given an opportunity to correct the situation.

For that reason, an employee considering resignation because of a serious deterioration in employment conditions should generally assess the legal position before submitting a resignation notice.

Employment agreements and separation agreements

Employment contracts may regulate salary, bonuses, commissions, confidentiality, intellectual property, restrictive covenants and other important obligations. A separation agreement may add releases, confidentiality obligations and post-employment restrictions.

When reviewing an exit proposal, one of the central questions is what the employee is receiving in addition to amounts already owed under the law or contract.

It is also important to identify exactly what claims the employee is being asked to waive and whether the economic value of the proposed package reasonably reflects the rights and risks involved.

Should every employment dispute become a lawsuit?

No. Filing a claim is one possible tool, not necessarily the first step in every case.

Before litigation, it is often useful to assess the legal grounds, available evidence, financial value of the dispute, likely arguments from the other side and whether sufficient leverage exists to reach a negotiated resolution.

A well-structured legal letter or negotiation can sometimes resolve a dispute without full proceedings. In other cases, delaying litigation may provide no strategic benefit. The decision should therefore be based on the particular facts rather than on a fixed formula.

IF NEGOTIATIONS DO NOT RESOLVE THE DISPUTE

What does an Israeli Labor Court case look like?

Some employment disputes can be resolved through correspondence or negotiation. Others require proceedings before the Labor Court.

Before filing a claim, the factual narrative should be established, the financial claims calculated, the supporting documents collected and the likely response of the opposing party considered.

Negotiation can also continue after proceedings begin. Effective litigation strategy therefore requires both the ability to pursue the case and continued assessment of whether an appropriate settlement can be achieved.

1
Case Assessment Documents, rights, amounts, evidence and potential weaknesses.
2
Letter & Negotiation Where appropriate, an attempt can be made to resolve the dispute before filing.
3
Filing the Claim Preparing the factual allegations, legal grounds and requested remedies.
4
Labor Court Proceedings Hearings, evidence, negotiations and continued litigation as required by the case.
EXECUTIVES & INTERNATIONAL COMPANIES

Employment disputes involving senior and international employees

Employment disputes involving executives or employees of multinational companies often require a broader analysis than a standard payroll dispute.

Compensation may include a significant variable component, such as quarterly or annual bonuses, sales commissions, equity or other incentive arrangements. Reporting lines may involve managers located outside Israel, while the employee's legal rights remain governed in whole or in part by Israeli law.

In these circumstances, the economic value of the dispute, the contractual documents, internal company communications and the practical objective of the employee or company should all be considered together.

The appropriate strategy may be to preserve the employment relationship, improve the terms of separation, recover outstanding compensation or prepare for litigation.

FREQUENTLY ASKED QUESTIONS

Questions about employment law in Israel

Do I need an employment lawyer before a termination hearing?

In many cases, obtaining advice before the hearing can be useful because the purpose of the process is to allow the employee to present his or her position before a final termination decision is made.

Can an employer in Israel terminate an employee without a hearing?

Israeli employment law generally recognizes an employee's right to a genuine opportunity to be heard before a final termination decision is made. The significance of a defective or absent hearing depends on the circumstances of the case.

I work for an international company. Does Israeli employment law apply to me?

Potentially. The answer depends on the circumstances, including the employment structure and applicable legal framework. Employees physically working in Israel may have rights under mandatory Israeli employment laws even where an international company or foreign entity is involved.

Can I negotiate a better termination package?

Sometimes. The strength of the negotiating position depends on the employee's contractual and statutory rights, possible defects in the termination process, compensation structure and the legal and commercial risks faced by both sides.

What should I check before signing a separation agreement?

It is important to distinguish between amounts already owed to the employee and additional compensation offered in exchange for a release. Confidentiality provisions, waivers, restrictive covenants and other continuing obligations should also be reviewed.

Am I entitled to commissions on deals completed after termination?

There is no single answer. The employment agreement, commission plan, conditions for earning the commission and circumstances of the transaction should be reviewed. In some disputes, substantial compensation may depend on transactions completed after employment ended.

Can an employment dispute be settled without going to court?

Yes. Many disputes can potentially be resolved through a legal letter or negotiation. Whether that approach is appropriate depends on the evidence, legal claims, financial value and bargaining position of the parties.

Where are employment disputes litigated in Israel?

Employment disputes falling within the jurisdiction of Israel's labor-court system are generally heard before the Regional Labor Courts, subject to the applicable jurisdictional rules.

How long does an employment lawsuit in Israel take?

There is no fixed duration. The timeline depends on the nature and complexity of the dispute, the evidence required, the court's schedule and whether the parties reach a settlement during the proceedings.

Does your office represent employers as well as employees?

Yes. The office advises and represents both employees and employers in employment-law matters, including termination procedures, contractual disputes, compensation issues, negotiations and Labor Court proceedings.
